General Travel and Business Terms of CroaMotoTours
Welcome to CroaMotoTours in Poreč, your specialist for guided motorcycle tours through Croatia. On this page, you will find all important information regarding our General Terms and Conditions (GTC). We value transparency and want to ensure that you are fully informed before booking your unforgettable tour with us. Please read the following points carefully to guarantee a smooth and hassle‑free experience
General
The following General Terms and Conditions (GTC) apply to the services offered and sold via the website www.croamototours.com (hereinafter referred to as the "Tour Operator").
---
Travel Contract
By booking an offer presented on www.croamototours.com, the traveler submits a binding offer to the Tour Operator to conclude a travel contract. The travel contract shall only come into effect upon acceptance by the Tour Operator. The Tour Operator accepts the traveler's booking by sending a booking confirmation.
By submitting a non-binding inquiry or requesting additional services related to an offer, the traveler requests an individual offer from the Tour Operator. By accepting this offer, the traveler submits a binding offer to the Tour Operator to conclude a travel contract. The travel contract shall only come into effect upon acceptance by the Tour Operator.
The Tour Operator accepts the traveler’s booking by sending a booking confirmation and a travel insurance certificate.
If the services stated in the booking confirmation differ from those of the originally offered tour or from the information provided at the time of booking, such booking confirmation shall constitute a new offer. The Tour Operator shall be bound by this offer for a period of 10 days. The travel contract shall be concluded on the basis of this offer if the traveler declares acceptance within this period. Acceptance may be made by written confirmation, payment of a deposit, payment of the travel price, or by commencing the tour.
The traveler may register for a tour or submit a booking inquiry using any booking method provided by the Tour Operator, such as through the booking system on the website, by telephone, or by email.
---
Services
The services to be provided by the Tour Operator are exclusively determined by the service description in the tour advertisement and the content of the booking confirmation. Other descriptions of travel services and pricing information shall only become part of the contract if expressly referenced in the service description. Any additional agreements validly concluded with the customer shall remain unaffected.
Changes or deviations from essential travel services that become necessary after the conclusion of the contract and that were not brought about by the Tour Operator in bad faith are permitted only if they are not significant and do not affect the overall nature of the booked tour.
The Tour Operator is obliged to inform the customer without undue delay of any changes or deviations in services.
In the event of a significant change to an essential travel service, the customer is entitled, free of charge, to withdraw from the travel contract or to request participation in a tour of at least equivalent value if the Tour Operator is able to offer such a tour without additional cost to the traveler.
The traveler must assert these rights against the Tour Operator immediately after receiving notification of the change.
The following are not considered essential travel services:
-
Changes to the route due to road conditions or weather conditions.
---
Services Not Utilized
If services properly offered are not utilized due to early departure or other compelling reasons, the Tour Operator shall endeavor to obtain reimbursement from the respective service providers for any expenses saved.
This obligation shall not apply if the services concerned are insignificant or if legal or governmental regulations prevent such reimbursement.
---
Payment
After the travel contract has been concluded, the travel security certificate will be sent to the traveler. A deposit of 20% of the total tour price is then due. The remaining balance must be paid no later than 45 days before the start of the tour.
If the booking is made less than 45 days before the start of the tour, the full tour price must be paid immediately upon receipt of the travel security certificate.
A deposit or full payment shall only become due after the traveler has received both the booking confirmation and the travel security certificate required pursuant to Section 651r (3) of the German Civil Code (BGB).
The traveler is not entitled to receive the booked travel services until the full tour price has been paid. If payment is not made in full, the travel contract may be terminated in accordance with the applicable cancellation policy.
All payments must be made by bank transfer to the company account specified on the invoice.
---
Cancellation by the Customer
The traveler may cancel the tour at any time before the start of the trip without observing any specific form requirements. However, cancellation in writing is recommended.
If the traveler cancels before the start of the trip or fails to commence the tour, the Tour Operator shall lose its entitlement to the tour price. However, the Tour Operator may claim reasonable compensation for expenses incurred and travel arrangements made, provided that the cancellation is not attributable to the Tour Operator and no case of force majeure exists.
When calculating such compensation, any expenses saved and any alternative use of the booked travel services that is reasonably possible shall be taken into account. The Tour Operator may calculate this compensation as a percentage of the tour price per person. The applicable cancellation deadlines are stated in the respective tour description.
The customer is entitled to prove that the Tour Operator has suffered no loss or a substantially lower loss than the cancellation fee claimed.
If the tour is significantly hindered, endangered, or impaired due to unforeseeable force majeure occurring after the contract has been concluded, both the Tour Operator and the traveler may terminate the contract. In such case, the Tour Operator may claim reasonable compensation for the travel services already provided or still required to conclude the tour.
---
Cancellation Fees
-
Up to 46 days before arrival: 0%
-
From 45 days before arrival: 30%
-
From 30 days before arrival: 60%
-
From 15 days before arrival: 100%
Any deviating cancellation fees will be specified separately in the respective tour description.
If the actual costs incurred as a result of the cancellation exceed the above flat-rate charges, the Tour Operator reserves the right to claim these higher costs.
The customer retains the right to prove that the Tour Operator suffered less damage than the amount claimed.
Where individual services are merely arranged through third-party providers, the cancellation terms and conditions of the respective service provider shall apply.
If the customer requests changes to individual travel services before the start of the tour, any resulting additional costs, cancellation fees, or rebooking charges shall be borne entirely by the customer.
We strongly recommend purchasing travel cancellation insurance.
---
Withdrawal and Termination by the Tour Operator
The Tour Operator may withdraw from the travel contract under the following circumstances:
-
If the minimum number of participants specified for the respective tour is not reached.
By booking a tour, the traveler confirms and warrants the following:
-
The traveler (rider) holds a valid driving license.
-
The motorcycle used for the tour is legally registered for public road traffic and is maintained in a roadworthy and safe condition at all times. Particular attention must be paid to wear parts such as tires.
-
The rider shall always comply with all applicable road traffic regulations, both those of the German Road Traffic Act and Road Traffic Licensing Regulations, as well as the traffic laws and regulations of any country visited during the tour.
-
The rider complies with all applicable requirements regarding motorcycle liability and vehicle insurance.
-
The traveler participates in the tour only while wearing appropriate motorcycle protective gear, including:
-
Helmet
-
Motorcycle boots
-
Gloves
-
Abrasion-resistant jacket
-
Abrasion-resistant trousers
-
-
The traveler is obliged, within the framework of applicable legal provisions, to cooperate in the event of service disruptions in order to avoid or minimize any damage.
-
In particular, the traveler is required to report any complaints or deficiencies immediately to the local tour guide or tour management. They are authorized to take corrective action whenever possible. If no local tour management exists, requests for remedial action must be addressed directly to the Tour Operator.
In such cases, the customer shall reimburse the Tour Operator for any costs incurred in accordance with the applicable cancellation fee regulations.
---
Termination of an Ongoing Tour
The Tour Operator may terminate a tour that has already commenced under the following circumstances:
If the tour guide is no longer able to continue the tour due to illness or injury and no suitable replacement can be provided.
In this case, the customer shall receive a proportional refund for services not yet provided.
If significant difficulties, dangers, or impairments arise due to unforeseeable circumstances beyond the control of the parties (force majeure) that could not reasonably have been foreseen at the time the contract was concluded.
In this case, both parties shall be entitled to terminate the travel contract.
A period of bad weather that merely makes motorcycle riding unpleasant shall expressly not be considered force majeure.
---
Violation of Traffic Regulations or Group Rules
If the customer violates the traffic regulations of the respective country, disregards the rules of the group tour, or repeatedly refuses to follow the instructions of the tour guide, the Tour Operator reserves the right to terminate the travel contract with immediate effect.
In such cases, no refund of the tour price or any other costs shall be granted.
---
Early Termination of the Tour and Non-Utilization of Services
If the traveler terminates the tour for reasons within their own sphere of responsibility (e.g., illness, mechanical breakdown of the motorcycle), or if individual services are not utilized, there shall generally be no entitlement to a refund of the proportional tour price.
However, the Tour Operator will make reasonable efforts to obtain reimbursement of any saved expenses or revenues from the possible resale of unused services from the respective service providers.
This shall not apply where the services concerned are insignificant or where reimbursement is prevented by statutory or governmental regulations.
For day tours, if the traveler arrives more than 20 minutes after the agreed meeting time, there is no entitlement to have the group wait or to receive the safety briefing or tour introduction a second time.
In such cases, the tour shall generally be deemed not to have been commenced by the traveler.
Subject to agreement with the tour guide, the traveler may rejoin the group at a later time and at a mutually agreed meeting point.
---
Liability
By participating in the tour, the traveler assumes full civil and criminal responsibility for any damage caused by their actions, including but not limited to personal injury, property damage, and consequential losses. The traveler is responsible for maintaining adequate insurance coverage.
The traveler shall indemnify and hold harmless the Tour Operator and its employees against any third-party claims arising from or related to damage caused or contributed to by the traveler.
This shall not affect the Tour Operator’s liability for intentional misconduct or gross negligence.
Where the Tour Operator uses agents, subcontractors, or other third parties to perform services, the Tour Operator shall only be liable for their careful selection and customary supervision.
In particular, the Tour Operator shall not be liable for damage resulting from road conditions, road defects, or the condition of the travel route.
The Tour Operator’s contractual liability for damages arising from the travel contract shall, except in cases involving personal injury, be limited to three times the total tour price, provided that:
-
the damage suffered by the traveler was not caused intentionally or through gross negligence by the Tour Operator; or
-
the Tour Operator is liable solely due to the fault of a service provider.
The Tour Operator shall not be liable for disruptions, deficiencies, or damages related to services that are merely recommended or arranged as third-party services, including but not limited to:
-
Flights
-
Ferry crossings
-
Events
-
Exhibitions
-
Sightseeing tours
-
Other excursions or activities
provided that such services are expressly identified as third-party services in the tour description.
Any claim for damages against the Tour Operator may be limited or excluded to the extent that, under international conventions or statutory provisions based on such conventions applicable to the services provided by a service provider, claims for damages against that service provider may only be asserted under certain conditions or limitations, or may be excluded entirely.
---
Insurance
No insurance policies are included in the tour price or the scope of services provided.
The Tour Operator strongly recommends that travelers obtain appropriate travel insurance coverage, including:
-
Travel cancellation insurance
-
Personal accident insurance
-
International health insurance
-
Medical repatriation insurance
In addition, the Tour Operator expressly recommends obtaining comprehensive roadside assistance coverage for motorcycle travel, such as an ADAC Plus Membership (or an equivalent international breakdown assistance program), as well as a dedicated motorcycle breakdown protection policy.
---
Waiver of Liability
By registering for a tour, the customer expressly acknowledges and agrees to the following:
-
I am aware of the risks associated with participating in a guided motorcycle tour.
-
I participate entirely at my own risk and agree that neither the Tour Operator nor any other persons or companies involved in the tour may be held liable for personal injury, property damage, financial loss, or any other impairment resulting from circumstances beyond their reasonable control (force majeure).
-
I acknowledge that the Tour Operator is not responsible for the actions, conduct, or negligence of other participants.
-
I recognize the authority of the Tour Operator and its agents, including the tour guide, in all matters relating to the organization of the tour, its execution, and decisions concerning safety.
-
I am solely responsible at all times for choosing my riding line and riding speed and for adapting both to the prevailing road, traffic, and weather conditions, including when riding behind a tour guide.
-
I undertake to avoid causing damage to nature and to refrain from unnecessarily disturbing local residents or third parties during the tour.
-
If I participate with my own motorcycle, I confirm that it is in proper technical condition and complies with all applicable noise regulations.
-
I am personally responsible for complying with all traffic laws and regulations in every country visited during the tour.
-
I confirm that I am in good health, meet the requirements of the booked motorcycle tour, possess a valid motorcycle driving licence of the appropriate category, and have sufficient riding experience.
-
I am responsible for ensuring that I have the required protective motorcycle gear and that my motorcycle is roadworthy and legally fit for use on public roads.
-
For my own safety, I undertake to wear the motorcycle protective equipment required by the Tour Operator throughout the entire duration of the tour.
---
Defects and Complaints
If the tour is not provided in accordance with the contract, the customer may request remedial action.
The Tour Operator may refuse such remedial action if it would require disproportionate effort or expense.
If the Tour Operator fails to provide remedial action within a reasonable period set by the customer, the customer may remedy the defect themselves and claim reimbursement of the necessary expenses.
Setting a deadline is not required if the Tour Operator refuses remedial action or if immediate remedial action is necessary due to a special interest of the customer.
For the duration of any service that is not provided in accordance with the contract, the customer may request a reduction of the tour price.
In addition, the customer may be entitled to claim damages where permitted by law.
The customer is obliged to report any travel defects or deficiencies to the Tour Operator without undue delay.
If the customer culpably fails to report a defect, any claim for a reduction of the tour price shall be excluded.
This shall not apply if reporting the defect would obviously have been futile or would have been unreasonable for other compelling reasons.
The customer must report defects immediately to the local tour guide.
If no tour guide is present at the travel destination, defects must be reported directly to the Tour Operator at its registered business address.
Contact details for the tour guide or the Tour Operator will be provided in the tour description or, at the latest, in the travel documents supplied before departure.
The tour guide is authorized to provide reasonable remedial assistance where possible but is not authorized to acknowledge claims or accept legal liability on behalf of the Tour Operator.
---
Notice Period Before Termination
If the customer intends to terminate the travel contract due to a travel defect or for another important reason that makes the continuation of the tour unreasonable and that is recognizable to the Tour Operator, the customer must first grant the Tour Operator a reasonable period of time to remedy the situation.
A notice period is not required if:
- The remedy is impossible.
- The Tour Operator refuses to provide a remedy.
- Immediate termination is justified due to a special interest of the customer that is apparent to the Tour Operator.
---
Travel Documents
The customer is required to inform the Tour Operator if they do not receive the necessary travel documents within the deadline communicated by the Tour Operator.
---
Rights and Duties of Tour Guides / Duty of Assistance
Tour guides are authorized to receive notifications of travel defects, complaints, and requests for remedial action from customers during the tour and, where possible and necessary, to provide reasonable assistance and corrective measures.
However, tour guides are not authorized to acknowledge or accept claims for a reduction of the tour price, compensation for damages, or any other legal claims on behalf of the Tour Operator, nor are they authorized to make any legally binding declarations on behalf of the Tour Operator.
---
Exclusion of Claims, Limitation Period, and Prohibition of Assignment
Contractual claims by the customer arising from the improper performance of travel services shall become time-barred after two years.
The limitation period shall commence on the day on which the tour was contractually scheduled to end.
To preserve the limitation period, claims must be submitted to the address specified below.
After the expiration of the limitation period, the customer may only assert claims if they were prevented from doing so within the prescribed period through no fault of their own.
The assignment of claims by the customer against the Tour Operator to third parties who did not participate in the tour is excluded.
---
Photos and Videos / Use for Promotional Purposes
The customer may object at any time, in writing, to the use of their personal data, including photographs and video recordings taken during the tour, for promotional purposes, such as publication on the Tour Operator’s website, social media channels, or marketing materials.
A brief notification, preferably by email (see contact details below), shall be sufficient for this purpose.
Photographs in which individuals are not identifiable, for example because their face is obscured by a motorcycle helmet, may be used unless the traveler has expressly objected to such use.
---
Rental of Motorcycles and Other Equipment
In connection with the rental of motorcycles or other equipment, the Tour Operator shall act solely as an intermediary, provided this has been expressly agreed.
Any contractual liability of the Tour Operator arising from its role as an intermediary is excluded.
---
Individual Agreements
Any individual agreements of any kind shall take precedence over these General Terms and Conditions and must be made in writing.
Tour guides are not authorized to make commitments, promises, or representations that deviate from these Travel and Rental Terms and Conditions.
Any commitments or representations made by tour guides shall not be binding upon the Tour Operator.
---
Severability Clause
Should any provision of the travel contract be or become invalid or unenforceable, the validity of the remaining provisions of the travel contract shall remain unaffected.
The same shall apply to these Travel and Business Terms and Conditions.
By registering for a tour, the customer acknowledges and accepts these provisions as binding for themselves and for all accompanying persons included in the booking.
The Tour Operator reserves the right to correct typographical, printing, and calculation errors.
---
Consumer Dispute Resolution
The Tour Operator does not participate in voluntary consumer dispute resolution procedures under the German Consumer Dispute Resolution Act (VSBG).
For all contracts concluded electronically after 15 February 2016, the Tour Operator refers customers to the European Online Dispute Resolution Platform (ODR Platform):
https://ec.europa.eu/consumers/odr/
---
Place of Jurisdiction
The place of jurisdiction for any disputes arising from the contractual relationship shall be Jülich, Germany, provided that the customer is a merchant, legal entity under public law, or a special fund under public law.
In all other cases, the general provisions of the German Code of Civil Procedure regarding local jurisdiction shall apply.
